A lawsuit filed on Nov. 13 alleges that a Berkeley County middle school in South Carolina threatened to expel a 13-year-old transgender student for using the boys’ bathroom, in violation of the state’s new bathroom law. The law, which took effect five months ago, requires students to use school bathrooms based on their biological sex. The student, whose identity is protected, was allegedly suspended for using the boys’ bathroom. LGBTQ rights group Alliance for Full Acceptance is advocating on his behalf, claiming that the bathroom law violates federal law and should be halted. The law has impacted transgender students statewide, with concerns for safe and inclusive school spaces. Senator Wes Climer pushed for the bathroom law after learning of a transgender student in his district using facilities not corresponding to their biological sex. The Biden administration has prohibited these laws under Title IX, but courts have blocked federal regulations in Republican-led states that sued to stop them. The Berkeley County School District and the state Department of Education have not commented on the case.
