A civil rights lawsuit is taking aim at South Carolina schools’ race and gender rules. The lawsuit challenges policies that require students to wear gender-specific uniforms and dictate the hairstyles that Black students can have. Filed by the American Civil Liberties Union and the National Women’s Law Center, the lawsuit argues that these rules perpetuate stereotypes and harm students’ self-esteem. The lawsuit specifically points to the case of a Black student who was punished for wearing her hair in afro puffs, which the school deemed “distracting.” The lawsuit argues that these policies violate Title IX, which prohibits discrimination based on sex in education programs or activities that receive federal funding. Additionally, the lawsuit argues that these policies also violate the Fourteenth Amendment’s equal protection clause. Supporters of the lawsuit argue that these rules unfairly target Black students and limit their ability to express themselves. The South Carolina Department of Education has yet to respond to the lawsuit.
