A new bill has been introduced by South Carolina lawmakers aimed at improving the state’s handling of cases involving impaired driving and driving under the influence (DUI). State Sen. Tom Davis filed Senate Bill S.52 with more than a dozen sections addressing gaps in current DUI laws. Measures include fines, incarceration, DUI victim impact panels, and felony charges for reckless driving or DUI causing bodily injury or property damage. The bill also includes provisions for offenders to pay child support in cases of caregiver death or disability in a collision, known as “Bentley’s Law.”
Despite these efforts, South Carolina continues to have a high rate of DUI fatalities, ranking second in the nation with 7.7 deaths for every 100,000 residents. The bill, introduced in December 2024, was referred to a Senate committee on Jan. 14 for further consideration. If passed, the bill is expected to bring about significant changes in how DUI cases are handled in the state.
