Special counsel who prosecuted Hunter Biden resigned in January without attracting attention


David Weiss, the federal attorney who investigated and prosecuted Hunter Biden, quietly resigned in January. He stepped down as U.S. attorney and special counsel on Jan. 17, three days before Donald Trump began his second term. Weiss submitted his resignation voluntarily and was not asked to resign. He was succeeded by acting U.S. Attorney Shannon T. Hanson.

Weiss concluded his investigation and issued his final report on Biden, criticizing President Joe Biden for pardoning his son. The cases brought by Weiss resulted in a guilty verdict on gun-related charges in Delaware and a guilty plea on tax and fraud charges in California. Hunter Biden was scheduled to be sentenced in December 2024 for both cases.

Weiss responded to President Biden’s criticism of the investigation, stating that politicians who attack decisions of career prosecutors undermine the public’s confidence in the criminal justice system. He wrote that the President’s statements unfairly impugn the integrity of Department of Justice personnel and all public servants making difficult decisions in good faith.

It was expected that Weiss would resign after concluding his investigation. No public statement or announcement was made at the time of his resignation, and his resignation letter has not been made public. The White House described the prosecution of Hunter Biden as a “miscarriage of justice,” while the special counsel disputed this in a court filing. Biden had repeatedly stated during the 2024 presidential campaign that he would not pardon his son.
